Terms of use
In short
- HyperActives keeps your trips and tells you what the airlines and flight data say. Always check with the airline before you act on a time.
- Your data stays yours. We only use it to run the service, as the privacy policy says.
- It is free while it is being tested. If that changes, you will be told in the app before anything is charged.
1. Who we are
HyperActives is a product of The Burrowbridge Group, LLC, a South Dakota limited liability company, at 519 W 22nd St Ste 300 #251343, Sioux Falls, South Dakota 57105-1745, United States. These terms are the agreement between you and us when you use the HyperActives app or this website.
2. What HyperActives is, and what it is not
It is a travel manager: it keeps the bookings you give it, shows them as trips, and passes on what flight data providers and airlines report about your flights. It is not a travel agent, a booking service or an airline, and it does not sell tickets, rooms or cars.
Flight information comes from third parties and can be wrong, late or missing. A gate, a time or a delay shown in the app is a report, not a promise. Before you act on it, check with the airline or the airport. We are not responsible for a missed flight, a missed connection or any cost that follows from relying on the app.
3. Your account
You sign in with a code sent to your email address. Keep that mailbox safe: whoever can read it can sign in as you. You can see every device signed in to your account in Settings and sign any of them out. Tell us if you think someone else has used your account.
4. Your data
What you put into HyperActives is yours. We use it only to run the service for you, as the privacy policy describes. You are responsible for what you enter being yours to enter, and for keeping your own copy of anything important: a confirmation, a ticket, a passport. We may stop keeping data you have deleted at any time.
5. Using it fairly
- Do not try to get into another person's account or data.
- Do not send the service more requests than a person using the app would.
- Do not use the app for anything unlawful.
We may close an account that breaks these rules, and we will tell you why unless the law prevents it.
6. Prices
HyperActives is free while it is being tested. If we introduce a paid plan, its price and what it includes will be shown in the app before you are asked to pay, and nothing already free will be taken away from an account without notice.
7. Changes to the service and to these terms
We change the app often while it is being built. We may add, change or remove features. When these terms change in a way that matters, the app will tell you before the change applies; if you keep using the app after that, the new terms apply.
8. Ending the agreement
You can end it at any time by deleting your account in the app (how). We can end it by closing the service or your account, with reasonable notice unless there is a serious breach.
9. Our liability
The service is provided as it is. To the extent the law allows, we are not liable for loss that comes from relying on information in the app, from the service being unavailable, or from anything outside our reasonable control, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, and nothing takes away rights you have as a consumer where you live.
10. Governing law
These terms are governed by the laws of the State of South Dakota, United States. If you live in the European Union or the United Kingdom, you keep the protection of the consumer laws of the country you live in, and you may bring a claim there.
